Uma identidade particular que se afirma na cena pública exprime, pela sua própria existência, um gesto de desafio à identidade dominante no Estado de dada sociedade. A afirmação identitária particularista se enuncia sempre como um nós dual que revela as falhas do universal : nós somos diferentes, mas nós somos iguais. A deslocação espaciotemporal obviamente não está segura senão em contexto social em que os direitos fundamentais são formalmente garantidos para todos os indivíduos; eis por que, em sentido moderno, uma minoria não existe senão em Estado de direito.O nosso objetivo é salientar o arrazoado socialmente situado que subentende a procura da equidade.
