Abstract
The concept of human dignity is central to the interpretation of the Canadian Charter of Rights and Freedoms, 1982. This paper examines the reasons why dignity has become and should remain a central element of Charter interpretation. First, it traces the philosophical and political underpinnings of the concept of human dignity and its incorporation into rights-protection instruments at the national and supra-national levels. It then looks to the postwar German constitutional order as a model of human dignity-based rights protection. Finally, it contends that Charter analysis has possessed less coherence and legitimacy because the Supreme Court has not consistently applied the understanding of human dignity that is now a foundational feature of modern rights-based democracy.
