Abstract
L’ Accord de Bangui , loi supranationale des États membres de l’Organisation africaine de la propriété intellectuelle (OAPI), régit aussi bien le droit de la propriété industrielle que le droit de la propriété intellectuelle. Alors que la réglementation des objets protégés par le droit d’auteur se rapproche beaucoup plus des standards appliqués au niveau international, le folklore qui est l’objet de notre étude bénéficie d’un régime particulier. En effet, les pays de l’OAPI, grâce à l’ Accord de Bangui révisé, ont établi une protection sui generis pour les expressions culturelles traditionnelles ou des expressions du folklore. Cette soumission du folklore à des règles particulières est l’objet de vives controverses. Néanmoins, même si cette protection particulière du folklore comporte intrinsèquement des limites, elle s’adapte mieux aux manifestations du folklore qui sont ondoyantes, diverses et variées.
