Parce que les fideles du Christ ont un droit a un service pastoral, l'Eglise oblige toute personne titulaire d'un office ecclesiastique du devoir de residence en un lieu specifique. Cet article examine la notion de residence et retrace brievement l'evolution de l'obligation de residence dans le droit ecclesiastique. L'attention est accordee a ces offices et dignites qui obligent la residence pour les personnes qui exercent une charge pastorale dans les Codes de 1917 et de 1983. Apres avoir examine le canon 2381 du Code de 1917, l'article etudie les differents elements du canon 1396 dans le Code de 1983, qui prescrit une peine obligatoire et indeterminee pour quelqu'un qui viole gravement l'obligation de residence. Enfin, l'article adresse les questions concernant le processus penal rattache a la violation de canon 1396.
