Abstract
O exercício da jurisdição constitucional para a defesado Estado Democrático de Direito é questão quetranscende a clássica separação de poderes, alcançamúltiplas perspectivas na visão de poder e encontra emPierre Bourdieu um referencial privilegiado paraanálise. A jurisdição constitucional brasileira,especialmente aquela exercida pelo Supremo TribunalFederal, justifica-se na defesa da Constituição erealização do Estado Democrático de Direito. Apersonificação/institucionalização do poder quecaracteriza o Estado como um todo e é especialmenteverificada no processo de escolha e nomeação deMinistros do Supremo Tribunal Federal ameaça,contudo, a legitimidade do judicial review e,paradoxalmente, fere o Estado Democrático que é suamissão defender. Existe solução? Bourdieucondicionaria tal possibilidade à alteração do habitusantidemocrático do Supremo Tribunal Federal, queperpetua e legitima a violência simbólica. Ascondições para que essa alteração possa se dar nocampo necessariamente passa pela democratização doprocesso de escolha e de tomada de decisão, o queexige efetiva participação da sociedade e mecanismosde controle eficazes.
