Abstract
On February 26, 2013, in Moreira v. Ontario Lottery and Gaming Corp., 2013 ONCA 121, the Ontario Court of Appeal released its first ever decision on the rules of play for roulette and the duty of care owed to gamblers. In the end, rules of play must be approved by the gaming regulator, the AGCO. Gambling is regulated for a reason: the public’s protection. In instances where the public suffers no detriment to the fairness or integrity of the game in question, there is no reason to have that practice approved by the regulator (i.e. the “floating ball rule”, in instance).
