Abstract
La question de la portée et de la substance des droits des peuples autochtones est constamment à l’avant-scène depuis que ces droits ont été reconnus et confirmés dans l’article 35 de la Loi constitutionnelle de 1982. La Cour suprême du Canada, tout en échafaudant, de jugement en jugement, un cadre interprétatif qui tend à « culturaliser » (plutôt qu’à politiser) les droits des peuples autochtones, n’a cessé d’exhorter les représentants élus autochtones et non autochtones à négocier, dans la sphère politique, les termes de la coexistence. D’un point de vue normatif, l’objectif de la définition des droits constitutionnels des peuples autochtones devrait être la conciliation d’ordres juridico-politiques distincts mais interreliés dans un rapport de non subordination, ce qui est difficilement compatible avec la stratégie d’extinction ou d’échange définitif des droits adoptée par la couronne. Or, le Québec, dans ses relations avec les Cris, les Inuits et les Innus, a récemment exploré une nouvelle réponse à la question de la définition des droits constitutionnels des peuples autochtones.
