Abstract
La propriété est-elle destinée à être perpétuelle? Si la propriété est certainement imprescriptible, l’imprescriptibilité doit être distinguée de la perpétuité. La reconnaissance de propriétés non perpétuelles par le droit positif québécois ou français, qui sont autant d’aléas au principe d’une propriété perpétuelle, pose la question de savoir si la perpétuité de la propriété n’est pas un symbole, voire un mythe. La thèse défendue ici est de dire que si la propriété est, en tant que prérogative fondamentale du droit des biens, destinée à être perpétuelle — par opposition aux droits réels démembrés ou droits sur la chose d’autrui, qui doivent être limités dans le temps pour ne pas porter atteinte à la structure du droit des biens et à la reconstitution de la propriété pleine et entière à l’extinction du démembrement — cette perpétuité n’est toutefois pas de l’essence de la propriété, ce qui explique les cas de propriété non perpétuelle ou à terme. Outre les exemples de la propriété superficiaire et de la copropriété, la propriété spatio-temporelle, la substitution, la propriété fiduciaire, ou encore la propriété intellectuelle peuvent s’analyser comme des exemples de propriété temporaire, remettant en cause le dogme d’une propriété absolument perpétuelle. La notion de modalité de la propriété, qui renvoie à une manière d’être de la propriété, ne saurait à ce titre faire écran au fait que la propriété peut ne pas être perpétuelle.
