Abstract
NA ODGOVORNOST POMORSKOG PRIJEVOZNIKA U PRIJEVOZU STVARI UDK: 341.362.1 Izvorni znanstveni rad Primljeno: ožujak 2011.Piratska djela u suvremenom svjetskom brodarstvu u znatnom su porastu i predstavljaju veliku opasnost za sigurnost pomorske plovidbe, za imovinu i ljudske živote.Veoma je aktualna raščlamba pravnog učinka piraterije (morskog razbojništva).U prvom dijelu rada autor obrađuje s međunarodnopravnog aspekta (pozivom poglavito na Konvenciju o pravu mora) kumulativne uvjete koji se moraju ispuniti za postojanje ovog međunarodnog zločina na moru.Osobito su relevantne mjere represije od strane država.Predlažu se i neke promjene i novine u sklopu klasičnog pojma piratstva, a u cilju učinkovitije borbe protiv ove suvremene pojave kriminala na moru.U drugom dijelu rada, sa stajališta pomorskog prava, autor obrađuje na temelju međunarodnih konvencija i domaćeg prava piratski čin kao događaj koji institutom izuzetih slučajeva utječe na odgovornost prijevoznika u prijevozu stvari.Ključne riječi: Piratstvo, međunarodni zločin na moru, kumulativni uvjeti, pravne posljedice, prijedlozi promjena, prijevoz stvari, piraterija kao izuzeti slučaj.
