Abstract
À la fois héritage historique et principe constitutionnel, la laïcité présente en France des caractéristiques bien spécifiques. Beaucoup s’interrogent toutefois sur l’évolution qu’elle pourrait être amenée à subir du fait à la fois des modifications socioculturelles visibles dans le pays et des engagements internationaux de la France et de sa présence dans l’espace européen. L’affaire des « foulards islamiques » peut servir de révélateur à cet égard. De fait, la jurisprudence du Conseil d’État marque déjà une évolution de la laïcité « à la française ». L’étude de cette affaire est élargie à d’autres pays d’Europe et d’Amérique et conclut sur l’avènement inéluctable d’une inflexion de la laïcité.
