French Abstract: Ce bref survol des fondements historiques et philosophiques de la liberte d’association tend a demontrer que le fait que la liberte d’association soit interpretee par les tribunaux dans une perspective individualiste et selon une philosophie politique liberale n’est pas un accident. A cet egard precis, la liberte d’association n’est guere differente de l’ensemble des droits et libertes fondamentaux enchâsses dans les constitutions modernes : il ne s’agit pas la d’un detournement « bourgeois » d’une nature fondamentale et atemporelle, mais d’une verite sur le contexte de l’apparition de ces droits comme categories de la pensee et de l’organisation de la societe liberale.English Abstract: This brief overview of the historical and philosophical foundations of the freedom of association argues that its interpretation by the courts from an individualist perspective and according to a liberal political philosophy is not an accident. In this sense, the freedom of association is no different from all of the fundamental rights and liberties protected by modern constitutions.
