La Convention sur la diversité biologique s’applique-t-elle à l’être humain ? Cette question a surgi récemment dans la controverse entourant le Projet sur la diversité du génome humain (PDGH). En effet, le programme de recherche proposé par le PDGH réfère expressément à l’idée d’une diversité génétique humaine. Or, à prime abord, rien dans la Convention sur la diversité biologique n’exclut l’être humain, qui est biologiquement couvert par les définitions données. Toutefois, au mois de novembre 1995, lors de sa seconde rencontre, la Conférence des Parties à la Convention excluait le matériel génétique humain du champ d’application de la Convention. Dans le cadre du présent article, l’auteure atteste du caractère bien-fondé de cette décision à la lumière de la Convention sur la diversité biologique. À cet égard, l’historique de la Convention, sa nature de même que la philosophie sous-jacente au texte de la Convention du point de vue du statut moral des animaux et des plantes sont discutés. Plus qu’un simple regard sur la Convention sur la diversité biologique, le présent article pose la problématique de l’élaboration d’une politique sur la diversité génétique humaine.
