Abstract
Le Code civil de 1889 n’acheva pas l’unification législative de tout l’État espagnol, de telle sorte que la Catalogne conserva son propre droit civil. Dans la plupart des matières, le droit civil catalan est d’application préférentielle sur le droit civil étatique. Postérieurement, la Constitution de 1978 a reconnu la pluralité d’ordres juridiques en Espagne, permettant non seulement la conservation et la modification du droit civil propre à chaque communauté autonome, mais aussi son développement. En Catalogne, cette possibilité s’est récemment matérialisée sous la forme de codes sectoriels : l’un relatif aux successions et l’autre relatif au droit de la famille. Un troisième code sectoriel concernant le droit patrimonial est en cours. Ainsi, la compilation de droit civil spécial adoptée en 1960 sous la dictature du général Francisco Franco est devenue obsolète et très incomplète dû au contexte politique de l’époque.
