L’abandon d’enfants : du Québec à la France en passant par l’Ontario

Abstract
Ce travail porte sur la question de l’abandon d’enfants analysée sous l’angle du droit comparé. Nous avons tenté d’y mettre en relief les différentes interprétations entourant la notion juridique d’abandon et les composantes des systèmes québécois, ontarien et français relativement aux mesures existant pour protéger l’enfant abandonné. Nous avons examiné principalement trois contextes juridiques différents : les lois sur la protection de l’enfant, l’autorité parentale et les déclarations d’abandon. Nous avons voulu mettre en lumière, entre autres, les mécanismes d’intervention en milieu familial en comparant les lois particulières du Canada au système d’assistance éducative de la France. Nous nous sommes aussi attardée à la déchéance de l’autorité parentale comme moyen supplémentaire de protéger l’enfant. Finalement, nous avons étudié le contexte des mesures permettant de rendre adoptable un enfant abandonné. Cette analyse nous a démontré qu’en cette matière, l’État québécois préconise un système hybride, c’est-à-dire un système alliant des interprétations et des mécanismes clairement inspirés de la common law à d’autres, purement civilistes.
