Abstract
Resume Tout recemment, la Cour supreme du Canada a ete appelee a trancher la question de savoir si le refus du gouvernement de la Colombie Britannique a financer le traitement pour la condition ABA/IBI comme service de sante pour les enfants souffrant de l’autisme restreignait les droits a l’egalite des requerants garantis par la Charte canadienne des droits et libertes. Les petitionnaires avaient demande soit le financement ou un service direct pour l’intervention ABA/IBI comme service assure sous le regime d’assurance-sante. Apres avoir passe en revue le pouvoir decisionnel du ministere public et la nature du pouvoir decisionnel discretionnaire, la Cour a conclu que le gouvernement n’a pas manque a ses obligations constitutionnelles lorsqu’il a refuse de financer le service.
