L’« imaginaire pénal » : penser les significations sociales de la punition du côté des espaces sociaux marginalisés

Abstract
Nous procédons dans un premier temps à une lecture critique de certaines des contributions majeures du champ de la sociologie de la punition afin de penser la peine au-delà de ses dimensions juridiques et sécuritaires, comme « institution sociale » complexe mobilisant des dimensions symboliques. Ces approches limitent toutefois la question du « sens » à celle de son « utilité » au sein d’un modèle théorique ou encore à celle qu’elle obtient des discours dominants dans un ensemble social. En nous inspirant de la pensée de Cornelius Castoriadis et de Jacques Rancière, nous proposons un programme théorique autour de la notion d’« imaginaire pénal » et de son pouvoir « instituant ». Il s’agit de favoriser une posture théorique en mesure d’accorder une valeur analytique réelle aux significations sociales de la punition qui sont produites au sein des espaces sociaux marginalisés. L’idée abstraite d’« imaginaire pénal » peut être opérationnalisée à partir d’une analyse discursive du « parler ordinaire » des espaces sociaux marginalisés.
