Abstract
As water becomes scarcer in North America, water users will seek out new sources. One source is rainwater. Although rainwater harvesting has been carried out on a small scale in the last few years it is more prevalent. Although capture of minor amounts of water may not have great impact, if considerable amounts were captured there could be adverse watershed impacts and effects on other users.Despite the growing rainwater harvesting, legal questions surrounding the right to capture and use rainwater are rarely raised, or addressed. Who owns the rain? The landowner? The government? Is there a common law right to capture and use rainwater? Is a statutory authorization required? Does jurisdiction matter? This paper provides legal analyses in addressing these questions. The paper focuses mainly on Alberta and Ontario, but a comparable could be carried out for other jurisdictions.
