Abstract
International instruments on Indigenous rights have increasingly offered universalized statements, but issues like land rights need to be sorted out on a domestic, contextual basis. Part of the author's larger body of work on this topic (with more forthcoming soon), this short paper considers the 2014 Supreme Court of Canada decision in Tsilhqot’in Nation v. British Columbia and discusses how the seemingly incidental choices courts make in applying Indigenous rights doctrines may inadvertently impede the economic prospects for Indigenous communities themselves. Particularistic determinations within domestic legal systems will have significant implications for the successful implementation of Indigenous rights.
