Abstract
Avec le vieillissement de la population, il appert que les situations d’exploitation financière des personnes âgées sont de plus en plus fréquentes. Afin de profiter d’une exonération de paiement pour les frais d’hébergement, des personnes âgées sont amenées à se départir, avant leur placement, de leurs biens sans juste considération. Malgré l’adoption de l’article 516 de la Loi sur les services de santé et services sociaux en 1991 pour freiner cette pratique, ces situations s’avèrent une pratique toujours actuelle. L’auteure analyse les diverses dispositions législatives visant la prévention de l’exploitation envers les personnes âgées afin de déterminer si elles peuvent contribuer à mettre fin à cette pratique.
