Abstract
There exist long debates on the issue of demarcation line between administrative violations of law and administrative crime. The reason lies in the relativity of administrative crime and the significant differences on criminal legislation forms between China and other countries. The main difference between them is the objective harm elements and the subjective requirements as well. When defining a harmful action to be administrative violation or crime, we should take into consideration of both the legislative purpose and legislative characteristics of our own country.
