Abstract

With economic development,Chinese marital status is not optimistic.The divorce rate continued to rise,which is damaging the interests of marriage,minor children and social interests.Relief system within marriage is on the base of theory of marriage and reference the exhaustion of internal remedies rules of company law.On the one hand,to set divorce barrie system,restrict hasty divorce;the other hand,it give relief measures to resolve marital problems for marriage party,which can avoid drastic and frustrating to divorce means.The relief system within marriage is consistent with civil law concept of private autonomy,and is consistent with the prohibition of abuse of rights principle,which can effectively reduce the divorce rate,maintenance of the harmonious marital relations and social stability.
