In September 2010,House of Representatives of United States passed Currency Reform for Fair Trade Act which is characterized as imposing currency exchange-rate policy into international trade by stipulating that fundamentally undervalued currencyconsititutes subsidies.The Act,however,violates international law in three aspects.First,its characterized measure is inconsistent with IMF Agreement and WTO Agreement on jurisdiction matters;second,United States has no right to unilaterally determine exchange rate undervaluation of other countries;third,according to standards provided by SCM Agreement,fundamentally undervalued currency does not contain features of export subsidies.For China,it is advised to insist exchange rate is of national sovereignty,explore ways to alleviate exchange-rate pressure from the United States,and resort to WTO dispute settlement body when necessary.
