Abstract
Plaintiff,the American company Nucor Fastener Division challenges the U.S.Department of Commerce's decision not to investigate an alleged subsidization by the People's Republic of China of the Chinese standard steel fastener industry through currency manipulation.On October 22,2010,the court of international trade of the U.S.made a decision as following: Because Nucor's challenge is unripe,the Motions to Dismiss filed by United States are GRANTED,and this action is dismissed in its entirety,but without prejudice.This article argues that,even if the RMB currency being undervalued,it could not be regarded as a subsidy under the WTO SCM agreement since there is no specific.
