Abstract
In recent years, international investment disputes caused by the host county's regulations on protecting public interests have increased significantly, while in arbitration activities public interests have been frequently ignored, which has highlighted the problem that the existing BIT system is lack of protection for public interests and that it is important and urgent to protect public interests. Thus, in recent years, the United Nations Conference on Trade and Development(UNCTAD) continuously warns all countries to attach importance to the protection of public interests in BIT, and the United States, Canada and other developed countries also emphasize the protection of public interests in the latest BIT model treaty. China, as a developing capital input power and the world's second largest BIT treaty signer, should pay much attention to the public interest protection in its future Sino-foreign BIT treaties by stipulating appropriate and effective public interest protection clauses therein.
