Abstract
The certain off-the-road tires exported to the United States by Hebei Starbright Tire Co.of China are accused of dumping and subsidies.The US Commerce and the International Trade Commission respectively made their final AD and CVD determinations,as well as the affirmative injury determination.Hebei Starbright Tire Co.of China,associated with their importer in the US,filed a motion for temporary injunctions with the US Court of International Trade.However,the motion was denied by the court.In this essay,we will introduce the basic background information of this case,summarize the reasoning of the court on the judgment,and finally,analyze the temporary restraining order in the American procedural rules referred in this case.Meanwhile,the possible mistakes made in the reasoning and ruling of the court would be pointed out.This case is a quotable experience for the Chinese enterprises to positively deal with the accusation of antidumping and countervailing by the US in the future.
