Abstract
In Canada renewable energy generator dispute,the Appellate Body opined that government's financial contributions that assist the creation of the renewable energy market are not a subsidy,but if government's invention distorts the market,then it may become a subsidy. The differentiation of market creation and market distortion by Appellate Body maintains members' policy space on renewable energy,and leaves uncertainty as well. Revision of SCM rules will be needed for the extension of green space under the WTO through restoration of non-actionable subsidy.
