Abstract
Mettant en relation étroite l’homme et les écosystèmes, les services écosystémiques provoquent un renversement de perspective : la nature n’est plus envisagée pour elle-même, mais pour les bénéfices qu’elle procure à l’homme. Ce nouveau regard, qui signe la reconnaissance d’une forme de dépendance de l’homme à la nature, ouvre la voie à une nouvelle approche juridique des enjeux liés aux écosystèmes et à la biodiversité. Il s’avère susceptible d’influer sur les réponses possibles apportées par le droit à la préservation de l’environnement et semble être vecteur de nouvelles approches, de nouveaux modes d’intervention du droit, au premier rang desquels l’émergence possible d’un « gradient de juridicité ». La rencontre de la discipline juridique et des paiements pour services environnementaux met justement en lumière cette nouvelle opportunité.
