Abstract
Based on the international treaty PRC joined,we shall protect the copyrights and trade mark rights of Incoterms.The nature of Incoterms protected by the law of copyrights and the law of trade mark shall be trade practice not the international usage under Chinese laws.As for the application of Incoterms 2010,our attitude shall be that it is a matter of fact not a matter of law.The application of Incoterms 2010 shall not be based on the article 142(2)of the Principals of Civil Law but on the provisions of the Contract Law.
