On the Application of Most-Favored-Nation Treatment on the Basis of the Case of Canada-Certain Measures Affecting the Automotive Industry

Abstract
This article points out three problems in applying Most-Favored-Nation Treatment by analyzing Canada-Certain Measures Affecting the Automotive Industry. The first problem is about explaining unconditionally in Article I of GATT 1994. The second problem is whether Article I of GATT 1994 involves both legal discrimination and factual discrimination. The third problem is whether Canada-Certain Measures Affecting the Automotive Industry could be exempted by Article 24 of GATT 1994. This article draws the conclusion that it is not interpretation of principles but interpretation of a certain concept that is placed emphasis on under the dispute settlement mechanism of WTO. This article also gives enlightening guidance for China to deal with how to apply Most-Favored-Nation Treatment.
