On WTO Members’ Right to Restrict Exportation of Natural Resources Products:Analysis on China-Exportation of Various Raw Materials

Abstract
The US, EC and Mexico challenged export measures of raw materials against China in WTO in 2009, of which the decisive legal point is GATT Article XX (g) taking account of China’s extensive com- mitments upon accession to WTO. Legal analysis demonstrates that China could win on GATT XX (g). In the current WTO framework, there is neither rule basis nor Members’ consensus to claim trade liberaliza- tion in natural resource products. Based on sovereign rights over territorial natural resource, China should not, and also unnecessarily, lift restrictions on exportation of natural resources products even if we lose this case.
