Abstract
Subrogation right is the key part of overseas investment insurance scheme,which is different from commercial insurance by the nature of International lawand Public Law.Compared with subrogation right of commercial insurance,it has more complicated theories such as Lex Personalis,National TreatmentandSovereignty Transfer.Till now,we still have no clear legislative mode on subrogation right of overseas investment insurance.Considering our current situation,it is better to adopt the U.S.mode of making BITs.
