The case regarding China's export measures on various raw materials is notable and latest to China's WTO dispute settlement.The case involves the legal issues of the legal application of the Protocol on the Accession,the WTO exception,the principle of judicial economy and the transparency.This paper outlines the basic facts and conclusions based on the major findings of the panel.We analyze the findings on whether China can invoke the GATT Article 20 to the Protocol,and how to apply it.This paper argues that although the success rate invoked is very low generally,China should seek to clarify legal basis on appeal when it invokes the GATT Article 20 to the Protocol Article 11.3.
