Abstract
The efficacy of third party beneficiary contract on third party beneficiary is inspected statically and dynamically. In the authors opinion, third party beneficiary is not the client of contract, but he/she has right to refuse the given benefit, right to claim of payment, right to receive payment, and right to request for protection. At the same time, third party beneficiary will also assume definite obligation. Consequently, third party beneficiary should have the right to institute a suit independently instead of intervene in the suit merely as the third party.
