Abstract
Warranty in Marine Insurance Act 1906 is an important rule which greatly effects the international marine insurance. Some countries with common law have the same rule as UK, such as USA and Canada. Although the harshness of the warranty has been criticized, but the warranty as a special system still plays important role in the marine insurance. Warranty in China Marine Insurance Law is very ambiguous with its concept and consequence of breach vacant. Therefore, it is necessary to establish and develop the warranty in China Marine Insurance Law by clarifying the concept of warranty and the consequence of breach of warranty, and by learning the rules of foreign countries.
