Abstract
The jurisdiction clause in commercial contracts plays a key role in determination of jurisdiction over commercial disputes. The choice between different kinds of jurisdiction clauses determines the litigation rights and duties of the parties and the courts. Selection between the exclusive and the non-exclusive concerns exclusiveness of the jurisdiction granted. Division into the floating and the mutual affects whether the plaintiffs have the right to choose litigating court or the court is decided on the bases of who is to start an action. If the court is mentioned in general terms, it is necessary to specify the adjudicating court according to domestic laws. The symmetrical and asymmetrical in the contents determine whether the choosing rights of both parties are on an equal footing. The complication in the jurisdiction clauses produces differences in binding effects, and results in different litigation risks. Participants in commercial transactions should pay much attention to and be aware of all these.
