Abstract
Les traités signés entre les Premières nations et le gouvernement canadien sont formellement inscrits dans la Constitution du pays et sont en cela la loi suprême du Canada. Les droits des autochtones et ceux découlant des traités qu’ils ont signés furent reconnus et confirmés par l’article 35 de la Loi constitutionnelle canadienne de 1982. Les traités numérotés furent signés avec les Premières nations entre 1871 et 1921. Au Manitoba, sept traités furent ainsi signés avec les Premières nations. Alors que des services de santé furent promis au cours des négociations de l’ensemble des traités numérotés, seul le Traité 6 comporte l’accord écrit selon lequel une armoire à pharmacie devait être fournie aux signataires. Cet article analyse les accords oraux et écrits concernant les droits à la santé dans les traités numérotés signés au Manitoba. L’analyse juridique établit le principe selon lequel les Premières nations du Manitoba possèdent des droits à la santé et aux services médicaux.
