Abstract
Les entreprises, comme les salariés, sont à la recherche de davantage de flexibilité. Le télétravail peut apporter une réponse à leurs attentes puisqu’il engendre une flexibilité spatio-temporelle du travail. Ce dispositif nécessite néanmoins de repenser l’organisation du travail. Pour encadrer le télétravail, il est donc indispensable d’établir des règles aussi bien pour protéger les intérêts des entreprises que des salariés. Or, le cadre légal actuel est insuffisant tant en Amérique du Nord, qu’au sein de l’Union Européenne. Notre étude a pour but à la fois d’exposer le cadre juridique européen et nord-américain, pour ensuite en mesurer l’impact sur la flexibilisation et l’organisation du travail au sein de l’entreprise.
