New Czech Foundation and Trust (like) Law: initial experience and reactions

Abstract
The new Czech private law has been in effect for two years, with legal practitioners gradually gaining the necessary experience. Out of the instruments available for the administration of (family) property, the most suitable appears to be the foundation fund (with legal personality), the legal regime of which is characterized by openness and flexibility. Another possibility is the trust fund (without legal personality), which is a trust-like form inspired by the concept of the fiducie in the law of Québec. However, the latter instrument has, so far, not enjoyed an unequivocally positive reception, and it will be of significant interest whether and how this ‘legal transplant’ will work in the Czech legal environment.
