Private toezichthouders als radertjes in wiens machine: die van de overheid of van bedrijven? De casus van zelfregulering in de uitzendbranche Overheden accepteren vaak private, helpende handen voor toezichtstaken, zoals normstelling, informatieverzameling en handhaving. Publieke toezichthouders ontmoeten in een dergelijk geval hun private collega’s. Voorbeelden van deze collega’s zijn zelfregulerende brancheorganisaties, die op hun beurt toezichtstaken hebben. Zij zijn te zien als de facto private toezichthouders tussen publieke toezichthouders en bedrijven. Hoe is de rol van private toezichthouders te typeren? In een uitgebreide casusbeschrijving over vervangende zelfregulering in de uitzendbranche exploreert de auteur de rol van private toezichthouders tussen overheid en de bedrijven waarop zij toezicht houden in. Zijn zij heel afhankelijk van de overheid, een radertje in haar machine? Of juist een radertje in de machine van de bedrijven die de schone schijn willen ophouden voor de overheid? De casus laat zien dat private toezichthouders niemands radertje zijn, maar beter te zien zijn als zelfstandige module die een ingewikkeld systeem van publieke en private regels gaande houdt. De casus is inspirerend voor de wetgever, want deze heeft de branche zelf de prikkels gegeven om zich op de huidige wijze te reguleren en daarmee de private toezichthouders de huidige rol gegeven. De bijdrage sluit af met een uiteenzetting van deze prikkels en de verklaring van hun werking.
