Abstract
Cette contribution présente la justice internationale pénale telle que vécue par les personnes jugées par les tribunaux pénaux internationaux (TPI). Fondée sur une série d’entretiens effectués avec les personnes condamnées ou acquittées par les TPI, elle intègre, dans l’analyse de la justice pénale internationale, le ressenti des acteurs des procès souvent oublié par la littérature : les accusés. L’analyse empirique permet de mettre en exergue le positionnement des personnes jugées tout autant que « les points de fixation et les points aveugles » de cette justice universelle. Il en ressort un sentiment d’être confronté à une justice hors du groupe, politisée et dans laquelle la guerre se poursuit. Les participants vivent cette expérience en « boucs émissaires ». Cette analyse témoigne de l’incertitude de l’impact international et judiciaire de la justice pénale internationale sur les personnes jugées.
