Abstract
La société de consommation a engendré des pratiques de nature à la sustenter. Parmi celles-ci, les pratiques de contrainte à la fidélité ou à la surconsommation (par exemple, l’obsolescence programmée) figurent au premier rang. Ces pratiques exercent sur l’acheteur une contrainte non seulement illégitime, mais aussi illégale : elles constituent ou engendrent des vices du contrat et des manquements aux obligations du vendeur. Le présent article met en relief les recours possibles de l’acheteur avant d’évaluer l’opportunité d’une intervention législative.
