Abstract
Cette note envisage les conséquences d’une éventuelle accession du Québec à la souveraineté en termes d’archives. Le sujet est abordé du point de vue de la pratique des États et de la Convention de Vienne sur la succession d’États en matière de biens, d’archives et de dettes d’États qui, jusqu’à présent, est restée lettre morte. Conformément à la pratique internationale et à la Convention de Vienne, il s’avère qu’advenant l’accession du Québec à la souveraineté, le transfert des archives canadiennes qui intéressent le Québec devrait être réglé par voie d’accord. Dans l’éventualité où un tel accord ne pourrait être conclu ou que certaines questions seraient négligées par lui, il semble que le principe de la territorialité des archives devrait jouer.
