Abstract
Cet article souhaite offrir de nouveaux outils épistémologiques et méthodologiques à la théorie critique du droit. Il expose en trois étapes comment le cadre conceptuel et méthodologique qu’offre la consubstantialité permet de mieux comprendre le rôle du droit positif dans la production et la reproduction dynamique des rapports sociaux. Pour illustrer cette approche, ce texte prend appui sur les apparentes contradictions qui traversent la situation des femmes en matière d’habitation. Certaines d’entre elles, dont principalement les femmes chefs d’une famille monoparentale et les femmes âgées, font partie des personnes qui connaissent le plus longtemps des besoins impérieux en matière de logement. À l’opposé, la montée de la popularité de la copropriété semble bénéfique et correspondre à certaines aspirations de liberté pour les femmes. Afin de mieux comprendre ce phénomène paradoxal, nous proposons l’usage de la méthode consubstantielle, qui permet une analyse croisée de l’action des rapports sociaux de classe et de sexe. Cette analyse sera appliquée à un objet précis, soit le Code civil du Québec.
