Abstract
C’est à l’occasion des travaux qui devaient mener à la publication du Traité de droit de la santé et des services sociaux1 que ma collègue Andrée Lajoie a démontré l’existence, en droit québécois, d’un droit aux services de santé qui permettait à chaque citoyen qui en était titulaire d’en exiger la réalisation auprès de ceux qui en étaient ainsi les débiteurs. Cette proposition, jusqu’alors inédite, découlait d’une analyse juridique classique du droit positif. En raison de certaines conséquences qui en découlaient sur la qualification des rapports établis entre les titulaires de ce droit et les personnes ou les institutions qui devaient en assurer l’exercice, cette nouvelle théorie a soulevé une controverse dans la doctrine que même les propos de la Cour d’appel, tenus près de vingt ans plus tard, n’ont pas complètement dissipé.
