Abstract
Cet article questionne la pluralité des usages du droit par le mouvement des pères séparés dans une perspective à la fois internationale – à l’aide de la littérature existante sur ce sujet – et comparative – à l’aide d’une enquête conduite en France et au Québec de 2008 à 2012 auprès d’associations de pères séparés. L’article propose dans un premier temps de cerner en quoi le droit et la politique de la famille sont un enjeu de taille dans l’émergence des revendications mobilisées par le mouvement des pères. Ensuite l’enquête comparative nous donnera des clés pour analyser non seulement la manière dont le droit est diffusé dans les associations de pères séparés françaises et québécoises, mais aussi la manière dont il est saisi et perçu par les membres de ces groupes.
