Abstract
La naissance du droit de la radiodiffusion constitue un objet privilégié pour analyser et comprendre la genèse de la communication audiovisuelle. Par-delà une simple visée historiographique, le présent article s’attache à saisir les enjeux sociaux, économiques, politiques, techniques… soulevés par l’apparition de ce nouveau média dans la mesure où ces différents enjeux ont été réfléchis avant tout dans la forme normative du droit. Le droit de l’audiovisuel s’est en effet édifié, en ayant à répondre en premier lieu à des nécessités de police et de politique (maintien de l’ordre public, souveraineté de l’État sur l’éther, puissance de ce dernier dans son rapport aux autres États, etc.) qui se sont progressivement estompées au point de disparaître, mais qui ont durablement déterminé à la fois la réflexion et l’évolution de l’audiovisuel.
