Abstract
La concesión de amnistías para facilitar la paz y la aplicación individual de sanciones para favorecer la justicia plantean una tensión que caracteriza a la justicia transicional. Estos dos extremos ofrecen un escenario oportuno para explorar la relación entre ley, sujeto y justicia desde una perspectiva psicoanalítica. Al situar la indagación alrededor del deseo y el goce que habitan al sujeto, se concluye que la justicia transicional debe centrarse más en la pregunta sobre cómo juzgar que sobre cómo castigar. En consecuencia, para el Trabajo Social se abre una vertiente de reflexión sobre la relación entre ley y cambio social.
