Abstract
L’article qui suit examine les nouvelles dispositions réglementaires en assurance-emploi prévoyant la rémunération minimale pour qu’un emploi soit qualifié de « convenable » et analyse en quoi ces dispositions modifient l’état du droit au regard de la jurisprudence antérieure à leur adoption. Dans un premier temps, l’auteure examine la définition d’« emploi convenable » au sens de la Loi sur l’assurance-emploi avant la réforme du 6 janvier 2013 et l’interprétation qui en était donnée par la jurisprudence au regard de la rémunération. Dans un deuxième temps, elle étudie les nouveaux critères relatifs à la rémunération d’un « emploi convenable », introduits dans le Règlement sur l’assurance-emploi. Dans un troisième temps, l’auteure s’intéresse à la notion de « situation financière moins avantageuse » prévue au nouveau règlement.
