French Abstract: Ce texte d'introduction au livre Droit international et de nouvelles approches dans le tiers monde: Entre repetition et renouveau» (Societe de legislation comparee, 2013) fait le point de la riche periode academique de droit et le developpement dans la pensee juridique francaise (1960-1980) . Elle fait valoir que le sujet a emerge en raison de circonstances particulieres et exceptionnelles, mais aussi que le champ etait depuis le debut marquee par de tres fortes tensions ideologiques internes qui ont fini par disloquant. Cela a suscite le scepticisme de ceux les plus crenele parmi les internationalistes qui ont ete chasses par l'espoir d'un monde plus juste et qui ont mene des luttes personnelles et professionnelles a cette fin. Il esquisse ensuite les differentes contributions de chercheurs Twail au livre et le travail engage avec leur bourse d'etudes qui ont initie une reflexion critique et renouvelee de la loi de developpement et de tous les efforts politiques et juridiques dedies au Tiers Monde selon 4 axes: (1) un revisionniste de l'histoire classique du droit international comme un moyen de faire avancer le projet colonial qui vise non seulement a deconstruire ce contexte historique, mais aussi a la question de l'existence du champ lui-meme; (2) une critique des droits de l'homme que la culture occidentale et la consequence naturalise des deroulement historique de l'hegemonie occidentale; (3) une reprimande severe de developpement lui-meme comme un concept occidental refletant a la fois materiel et la violence symbolique envers le peuple et les mouvements sociaux du Tiers-Monde; et (4), une reflexion sur les moyens d'engager le Tiers-Monde aujourd'hui dans nos activites de recherche et pedagogiques, mais aussi sur la diffusion d'informations et de connaissances sur le Tiers Monde comme une entreprise epistemologique etrange qui cherche a consolider systematiquement les dichotomies qui hantent pas que le droit international, mais les discours de toutes les nuances.English Abstract: This introductory text to the book International Law and New Approaches to the Third World: Between Repetition and Renewal (Societe de legislation comparee, 2013) takes stock of the rich academic period of law and development in French legal thought (1960-1980). It argues that the topic emerged because of peculiar and exceptional circumstances but also that the field was from the beginning marred by very strong internal ideological tensions which ended up dislocating it. This aroused the skepticism of those most embattled amongst internationalists who were driven by the hope of a more just world and who waged personal and professional struggles for that purpose. It then sketches the various contributions of TWAIL scholars to the book and work engaged with their scholarship that have initiated a critical and renewed thinking of law of development and of all political and legal endeavours dedicated to the Third World along 4 axes: (1) a revisionist account of the classical history of international law as a mean of furthering the colonial project that not only aims to deconstruct that historical background but also to question the existence of the field itself; (2) a critique of human rights as Western culture and the naturalized consequence of the historical unfolding of Western hegemony; (3) a sharp rebuke of development itself as a Western concept reflecting both material and symbolic violence toward the people and social movements of the Third World; and (4), a reflection on the means of engaging the Third World today in our scholarly and pedagogical activities, but also upon the diffusion of information and knowledge regarding the Third World as an uncanny epistemological enterprise seeking to systematically entrench the dichotomies that haunt not only international law but discourses of all shades.
