Abstract
La notion de « propriété » rurale ne se laisse enfermer ni dans des cadres juridiques rigides, ni dans d’incontestables statistiques dans la mesure où elle se trouve constamment nuancée, pour peu que l’on étudie les situations concrètes sur le terrain, par celle de « possession ». À l’origine de la confusion, parfois intentionnellement entretenue, les pratiques emphytéotiques, de droit ou de fait, conduisent l’exploitant à disposer du bien d’autrui comme d’une véritable propriété et autorisent la transmission d’une génération à l’autre (Erblehn) de corps de biens entiers, non partageables parce que rattachés à la ferme (Hoflehn). Sans être spécifique à la province, l’emphytéose est inséparable du contexte juridico-foncier de l’espace rhénan, de la conjoncture propre à l’Alsace entre le milieu du XVIIe et la fin du XVIIIe siècle et de structures sociales plus ou moins inégalitaires. Au-delà du formalisme juridique, elle nous invite à aborder l’histoire des mentalités.
